Federal immigration agents consider the undocumented Norwalk woman who took refuge in a church to avoid deportation a fugitive, but it’s unlikely they’ll enter the church to take her into custody.

Instead of boarding a flight back to her native Guatemala as instructed by Immigration and Customs Enforcement Nury Chavarria headed Thursday evening to the Iglesia De Dios Pentecostal church in the city’s Fair Haven section.

New Haven 07/21/2017 Senators Blumenthal and Murphy and Representative DeLauro hold a press conference outside of Iglesia De Dios Pentecostal church in the Fair Haven in New Haven on Friday afternoon after meeting with Nury Chavarria, 43, who has lived in the United States for 24 years and was slated to be deported on Thursday. Instead she took refuge with her daughter at Iglesia De Dios Pentecostal church. ICE considers Chavarria a fugitive, but don’t generally conduct enforcement operations at churches. Chavarria and her 9 year old daughter remained at the church Friday as members of the media gathered outside. The Rev. H Otero, pastor of the church, said he didn’t know how long she would remain there.

“We don’t have a time frame on how long it’ll take to resolve this case but we have contemplated different options and alternatives and talked to many [about] legal options,” he said. Otero said the support Chavarria has seen from elected officials and the community has “brought her some faith and some hope.”

Sens. Richard Blumenthal and Chris Murphy and Rep. Rosa DeLauro stopped by the church in the afternoon to meet with Chavarria.

“What she said was, ‘I’ve been in this country for most of my life. I love this country. I love my kids. I work hard. I don’t want to be without my kids. I live for my kids,'” DeLauro said. Chavarria has been working and paying taxes, but she cannot apply for a green card because she entered the country illegally.

“What we are asking for now is an extension of time for us to determine if there is any other way, but for now, unfortunately, under the current immigration laws, she’s not eligible,” Echeverr said.

Kaupas of Branford came to the church to drop of coloring books for Chavarria’s daughter, Hayley. He said his parents escaped Soviet occupation of Lithuania toward the end of World War II and he was born in Germany. as refugees.

I’m moved by the love that Nury is demonstrating for her children and I’m impressed by her courage and bravery to stand for what she believes is right. And I’m really encouraged by the support the community around her is giving her.”

Gov. Dannel P. Malloy visited Echeverr at the church Thursday evening. He said the attempt to deport Chavarria, a mother of four who has lived in the country for 24 years, stands in contrast with President Donald Trump’s claim that his immigration policies are focused on deporting “the bad guys.”

When asked if he condoned what Chavarria had done,

Malloy said Friday: “What I don’t condone is the federal government lying to the people of the United States. What I don’t condone is a Secretary of Homeland Security on . at least two occasions, in a room [where] I was running the meeting, assuring us that their efforts weren’t after people who were good, decent people.”

“At some point human decency should play a role,” Malloy said. “When someone is largely responsible for the welfare of four children, one of whom is disabled, the idea that we would force that woman to leave this country, knowing, by the way, that she can’t take those children with her, . yeah, I’m raising my voice. This is wrong. Her 21 year old son has cerebral palsy and requires her care, she said. Romano, chairman of the state Republican Party, was sympathetic to Chavarria’s case, but critical of Malloy.

“He stands there in this situation because it’s scoring easy political points for the Democratic Party,” he said. “Where was Dan Malloy when Barack Obama deported more undocumented immigrants than any other president before. When Barack Obama was doing it, why didn’t he stand up?”

Federal agents are unlikely to get any help in apprehending Chavarria from New Haven police. New Haven has declared itself a “sanctuary city,” where local officials leave immigration enforcement to ICE.

“In New Haven there is a strict sense that federal immigration law is the purview and responsibility of the federal government, so in New Haven compliance matters are ceded to federal officials,” said Laurence Grotheer, a spokesman for New Haven Mayor Toni Harp.

Chavarria applied for asylum after she fled Guatemala but her case was denied. She was given orders of deportation in 1998 and 1999 but did not comply. In 2010, Walls said, she was given a one year stay of removal “on humanitarian grounds.” That stay was extended annually until this year, when she was told she would have to leave. Advocates say the circumstances of her case have changed due to stepped up immigration enforcement under Trump.
